With the Decree n. 135 of 14 December 2018, article 8-ter, the definition of a distributed ledger technology has been introduced in our legal system, paving the way for an Italian blockchain regulation. Despite the positive aspects of such a provision, some criticalities seem to arise when considering the possible use of such a technology by a public administration, exploiting the aforementioned provision. It is therefore the purpose of this paper to propose some interpretative considerations in this regard, also highlighting the main problematic aspects in terms of the protection of personal data and of the environment.

With the decision of the Court of Justice of the European Union that is going to be analyzed herein, the European judge focuses on the primary purpose of investigating the possibility of considering the Italian F.I.G.C. (Federazione Italiana Giuoco Calcio) a body governed by public law. In this respect, the comment aims at summarizing the main issues concerning the mentioned body, especially with regard to the conditions provided for by law in order to recognize such public entity. At the end of the note some critical considerations will be made about the decision.

The document contained herein has been inspired by the popular paper written by the anonymous entity well-known as Satoshi Nakamoto, which describes the complex way a blockchain transaction works. It has been of primary interest to examine the possibility that such a technological instrument can be helpful for the Italian Public Administration, which notoriously is characterized by a lazy digitalization progress.
